These Terms of Service ("Terms") form a binding contract between you and H-Kay Limited (company number 10417923), trading as Tender Risk Assurance (the "Service"). By purchasing any product or using this website, you accept these Terms.
We sell digital compliance products — including the CQC Premium Compliance Suite, Gap Checker, New Provider Bundle, and Expert Consultation services — primarily aimed at UK care providers regulated by the Care Quality Commission. Product specifications are described on each product page.
When you purchase a digital product, you receive a single-organisation licence unless stated otherwise. This means:
Consultants requiring multi-client deployment rights must obtain a Consultant Licence — contact us for commercial terms.
Digital products are delivered via a secure download link sent to the email address you provide at checkout. Links are valid for 72 hours and permit up to 3 downloads. Expired or lost links can be reissued on request — email us with your receipt reference.
Prices are displayed in British Pounds Sterling (GBP). H-Kay Limited is not currently VAT-registered, so no VAT is chargeable. Payment is processed securely by Stripe. We do not store card details. Early-bird pricing is available for the first 10 customers of each applicable product; once that limit is reached, the standard price applies to all subsequent orders.
We offer a 14-day no-quibble refund on digital products. If the product does not meet your needs, email us within 14 days of purchase and we will refund in full. You are not required to delete or return the files. See our full Refund Policy. Expert Consultation sessions are non-refundable once the call has taken place.
All content on this website and all products we sell are the intellectual property of H-Kay Limited unless expressly licensed to you. Your purchase licences you to use the documents as described in section 3 but does not transfer copyright.
Our products are compliance resources, not legal, regulatory, or clinical advice. You remain responsible for your organisation's compliance with the Care Quality Commission, UK law, and any other applicable regulations. Using our products does not guarantee a CQC rating or inspection outcome.
To the maximum extent permitted by law, our total liability to you arising from any product or service we provide is limited to the amount you paid for that product or service. We are not liable for:
Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
Customers of the Premium Suite receive a unique referral code. When a new customer uses your code at checkout, your next annual update licence is provided free of charge. Credits are applied after the 14-day refund window clears. Self-referral (buyer = referrer) is not permitted. Credits are non-transferable and have no cash value.
We may suspend or terminate your access to the Service if you breach these Terms — including attempting to resell or redistribute the documents outside your licence. Your licence to use any products you've already lawfully purchased survives such termination, but we may decline future purchases.
These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. Material changes will be notified by email to existing customers. Continued use of the Service after an update constitutes acceptance.
